These Terms and Conditions apply to purchases of digital products from Epiales Records through epialesrecords.com. By placing an order, you agree to these terms. Mandatory consumer rights under applicable law remain unaffected.
1. Digital products
Products sold through the store are digital downloads, including synthesizer presets, wavetables, noises, sound-design files, and related documentation. No physical item will be shipped. Product pages describe the included files and any required software or compatibility information.
2. Orders and payment
An order becomes binding when payment is successfully authorized and an order confirmation is issued. Prices and any applicable taxes are shown during checkout. Payments are processed by the payment provider selected at checkout.
3. Delivery
Download access is normally provided automatically after successful payment through the order confirmation page, customer account, or order email. Customers are responsible for providing a valid email address and maintaining access to it. If a download is unavailable, contact customer support using the contact information on this website or in the order email.
4. Software requirements and compatibility
Customers must check the stated software, version, operating-system, and file-format requirements before ordering. Unless a product page states otherwise, the customer is responsible for obtaining any required third-party software. References to third-party products and trademarks are for compatibility identification only.
5. License
After full payment, the customer receives a personal, non-exclusive, non-transferable license to use the purchased files in original music and audio productions, including commercial releases, performances, videos, games, and client projects.
The customer may not resell, redistribute, share, sublicense, upload, trade, or make the source files available to others, whether unchanged or modified. The files may not be included in another preset pack, sample pack, sound library, template, or competing product. A finished musical or audiovisual work that incorporates the files is permitted.
6. Intellectual property
All rights not expressly granted remain with Epiales Records or the applicable rights holder. Purchasing a product does not transfer ownership of the underlying files, branding, artwork, or documentation.
7. Withdrawal rights for digital content
Consumers may have a statutory right of withdrawal for distance contracts. For digital content supplied immediately and not on a physical medium, that right may expire only when all legal requirements are satisfied, including the customer’s express consent to immediate performance, acknowledgement of the resulting loss of the withdrawal right, and confirmation in a durable form where required by law. These Terms alone do not replace any separate consent or acknowledgement required at checkout.
8. Refunds, defects, and support
Nothing in these Terms limits mandatory rights relating to defective or non-conforming digital content. If files are corrupted, incomplete, materially different from the product description, or cannot be accessed, contact support with the order details so the issue can be investigated and, where appropriate, corrected, replaced, or refunded.
Requests based only on a change of mind are handled according to applicable consumer law and any consent given for immediate digital delivery.
9. Customer responsibilities
Customers must not use the products unlawfully, infringe third-party rights, bypass technical restrictions, or attempt unauthorized access to the store or its delivery systems. Account and download links must be kept secure.
10. Liability
Epiales Records remains liable where liability cannot legally be excluded or limited, including mandatory consumer-protection rules. Subject to those rules, liability for indirect or consequential loss is limited to the extent permitted by law. Customers remain responsible for backing up downloaded files and production projects.
11. Changes and severability
The version presented at the time of purchase applies to that order. If any provision is invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law.
